FDIC Director Suits: Lessons Learned

The American Association of Bank Directors has undertaken a review of the FDIC's civil suits against directors of failed banks and savings institutions to find out what directors of open banks can learn from the 34 complaints (involving more than 250 directors) filed from July 2010 through October 29, 2012.

We undertook this study primarily to assist AABD members and others who currently serve as bank directors in helping to avoid the fate of those who have been sued. Studies on the causes of bank failures and what can be learned from them are plentiful for the failures of banks and savings and loans during the S&L crisis of the late 1980s and early 1990s, but not for the more recent failures.
