Buckley Sandler Webcast: State Regulatory and Enforcement Issues Series – Part One: Overview of Current Regulatory Climate

On April 27, 2017, Buckley Sandler hosted the first of a five-part series of webcasts focused on state regulatory and enforcement issues and trends. The focus of the first webcast in this series was an overview of the current regulatory climate as well as a discussion about the anticipated increase in state oversight and enforcement as a result of the Trump Administration’s expected efforts to limit the authority and agenda of the select federal agencies that have authority over consumer financial service providers through the Dodd-Frank Act, namely the CFPB.  The first webcast also discussed issues of increased or renewed interest to state regulatory agencies and state attorneys general as well as provided an overview of updates and changes to the Nationwide Mortgage Licensing System.  

Subsequent webcasts will run over the course of the next few weeks, as Buckley Sandler attorneys cover the following:

  • Mortgage Licensing and Regulation: This session will focus on current trends in the mortgage licensing and regulation space, such as the re-emerging wholesale mortgage broker channel, understanding the third-party loan fulfillment space, recent regulatory shifts in regulatory treatment of master servicers, and increased activity in the reverse mortgage lenders/servicer space
     
  • Fintech and Consumer Lender Licensing and Regulation: Building off the mortgage licensing and regulation discussion, this session will turn to more recent state licensing and regulatory developments in the consumer loan space (e.g., marketplace lenders, student lenders, solar financing, auto financing), as well as licensing of other fintech companies, including payments companies and other money transmitters and virtual currency companies
     
  • Changes of Control and Other Significant Events Impacting State Licensed Entities: This session will help licensees navigate the extensive world of post-licensing issues, including change of control and asset deals, as well as other significant events and the regulatory risk and challenges they pose
     
  • Examination and Enforcement Trends: This session will discuss the potential for increased state examinations, including Multi-State Mortgage Exams, for mortgage licensees, as well as recent state enforcement cases and increasing activity by state attorneys general involving mortgage companies, marketplace lending platforms and others
