Buckley Sandler Webcast: Website Accessibility - Staying Compliant with the ADA

Banks are beginning to receive demand letters from plaintiffs' lawyers that assert violations of the American with Disabilities Act (ADA) by not maintaining websites that provide appropriate access to consumers with disabilities. The demand letters rely heavily on an advance notice of proposed rulemaking (ANPR) proposed by the U.S. Department of Justice (DOJ) in 2010 but not yet finalized. That ANPR referred to the applicability of a protocol for website ADA compliance known as Web Content Accessibility Guidelines version 2.0 AA criteria (“WCAG 2.0 AA”). The ANPR also relies on an interpretation of Title III of ADA which requires “public accommodations” to provide accessible facilities and to take steps to communicate effectively with consumers with disabilities.

During the first half of this webcast, we will provide background on the DOJ’s rulemaking process and the anticipated timeline for issuance of a proposed rule. We will also explain recent DOJ enforcement actions that have required the WCAG 2.0AA standard for websites, even in the absence of a final rule. Finally, we will provide practical advice on how banks should review their websites to meet ADA website accessibility standards and guidance on what to do if your bank is threatened with a lawsuit.

In the second half of the webcast, Wells Fargo representatives will provide demonstrations of ADA best practices for online content. They will also explain how assistive technology can be used to help disabled consumers properly access website information, content and features.
