The California Supreme Court on Thursday revived a homeowner’s lawsuit against New Century Mortgage, Ocwen Loan Servicing and others over her foreclosure, ruling borrowers have standing to claim that an assignment of a note and deed of trust is void.

Reversing a state appeals court’s decision, the California Supreme Court issued a ruling that could upend the well-developed statutory process that lenders have come to expect in California to push through nonjudiciary foreclosures.

Fredrick S. Levin, a partner with Los Angeles-based firm Buckley Sandler LLP, told Law360 on Thursday that the California Supreme Court’s ruling “opens the door to lawsuits by borrowers claiming that their homes were improperly foreclosed upon by persons who allegedly lacked power under California law to institute foreclosure.”
