The Securities and Exchange Commission has intervened in a legal battle between mutual fund giant Vanguard Group and one of the company’s former lawyers, claiming the ex-employee should qualify for U.S. whistleblower protections.

The agency on Monday filed a brief in support of David Danon, a former lawyer at the Malvern, Pa.-based money manager who said Vanguard fired him because he raised concerns about some of the firm’s tax practices.

He filed a wrongful termination lawsuit against the company in the U.S. District Court for the Eastern District of Pennsylvania late last year. Vanguard has filed a motion seeking to dismiss the case, and Mr. Danon has asked the court to deny that motion.

“It’s the business community versus the whistleblower community,” said Thomas Sporkin, a partner at law firm Buckley Sandler LLP who helped launch the SEC’s whistleblower office and now advises firms on whistleblower matters. It is “ironic” that some companies are now fighting what they asked for as the rules were being written, he added.
