Biography

Amanda R. Lawrence has successfully represented individuals and corporate clients in high-stakes class action and complex civil litigation throughout the country. As a Partner in the Washington, D.C., office of Buckley Sandler LLP, her work focuses on defending financial services industry clients in mortgage loan repurchase and indemnification claims related to residential mortgage-backed securities (RMBS) and consumer cases, both individual and class actions, arising under federal and state consumer protection statutes. Her work includes cases involving unfair, deceptive, and abusive acts and practices (UDAAP), securities fraud, the Fair Housing Act (FHA), the Equal Credit Opportunity Act (ECOA), the Civil Rights Act, and unfair and deceptive trade practices statutes.

Ms. Lawrence also assists clients in matters before the Department of Justice (DOJ), the Consumer Financial Protection Bureau (CFPB), the Securities and Exchange Commission (SEC), federal and state bank regulators, and state attorneys general. In addition, Ms. Lawrence counsels clients on risk management strategies and compliance with various federal and state laws and regulations affecting the financial services industry.

Ms. Lawrence’s recent representations include:

  • Defending multiple correspondent lenders in lawsuits brought by a liquidating trust of a bankrupt securitizer alleging breach of contract and indemnification based on purported defects in mortgage loans that were securitized into private RMBS
     
  • Reviewing and assessing loan repurchase demands on behalf of mortgage originators, performing risk assessments of loan portfolios, and handling loan-repurchase litigation
     
  • Defending a lender placed insurance provider in multiple putative class actions
     
  • Defending a student loan trust securitizer and its subsidiaries in a putative state class action alleging federal and state Fair Debt Collection Practices Act (FDCPA) violations and unfair trade practices
     
  • Acting as national litigation counsel for a home mortgage loan servicer and its subsidiaries in connection with more than 30 cease and desist orders from state banking commissioners
     
  • Defending an online lender in a lawsuit brought by the Virginia Attorney General claiming violation of the Virginia Consumer Protection Act related to interest rates charged on closed-end products based on choice-of-law provisions
     
  • Representing a large bank in one of the CFPB’s first enforcement actions, a joint investigation and enforcement action with the Federal Deposit Insurance Corporation (FDIC), alleging deceptive sales practices in connection with add-on products
     
  • Several CFPB examinations and investigations, including examinations and investigations related to add-on products, student loan servicing, and lending for nonbank institutions
     
  • Conducting risk assessments of major mortgage servicers’ practices pursuant to FDIC and Federal Reserve Consent Orders, as well as fair lending and UDAAP risk assessments for large financial institutions regarding nonmortgage products

Ms. Lawrence is a frequent author and lecturer on litigation and compliance issues impacting the financial services industry including on topics such as mortgage origination enforcement and litigation, RMBS, class actions, and CFPB and other prudential regulator priorities. 

Ms. Lawrence is a member of the firm’s Pro Bono Committee and has an active pro bono practice. She is a member of Law360’s Banking Editorial Advisory Board, was recently named a Fellow in the Litigation Counsel of America Trial Lawyer Honorary Society, and is the former Chair of the Women Litigator’s Committee of the D.C. Bar. Prior to joining Buckley Sandler, Ms. Lawrence was an Associate at Skadden, Arps, Slate, Meagher & Flom, LLP. She received her J.D. from Case Western Reserve University and her B.A. from Rhodes College.
