Biography

Over a 40 year career, Jerry Buckley has established himself as an acknowledged leader in financial services law. He is a founding partner of Buckley Sandler LLP and founder of Treliant Risk Advisors LLC, a leading consulting firm serving the financial services industry.

Mr. Buckley assists his clients — banks, mortgage companies, credit card issuers, insurance companies, broker dealers, fintech lenders, investment banks, and private equity investors — with strategic counsel and advice on business formations and acquisitions, risk management, and enforcement matters involving federal and state regulators.

Mr. Buckley’s practice involves the defense of companies that are targets of inquiries or enforcement actions by the Office of the Comptroller of the Currency (OCC), Federal Deposit Insurance Corporation (FDIC), Federal Reserve, Consumer Financial Protection Bureau (CFPB), Federal Trade Commission (FTC), Department of Housing and Urban Development (HUD), and state attorneys general.

An article he wrote in the American Banker in 2016, “The Compliance Officer Bill of Rights,” focused attention on the growing risks faced by compliance officers. This led to a symposium on “Rights and Responsibilities of Today’s Chief Compliance Officers  Their Evolving Role,” which was chaired by Mr. Buckley and sponsored by American University Washington College of Law. Chief compliance officers from the nation’s leading companies participated in this seminal discussion about how to define and make safe the job of a chief compliance officer.

Mr. Buckley acts as counsel for a number of national services trade associations in matters before regulatory agencies and Congress, and in filing amicus curiae briefs related to the interpretation of banking and consumer finance laws in cases before the U.S. Supreme Court and appellate courts. He has extensive experience with electronic signatures. He serves as General Counsel of the Electronic Signatures and Records Association (ESRA); and he played a leading role in negotiations that led to the enactment of the federal E-Sign Act authorizing the nationwide use of electronic signatures and records; counsel the Drafting Committee for Standards and Procedures for Electronic Records and Signatures; and is co-author of The Law of Electronic Signatures and Records (West, 2009).

Mr. Buckley is a co-founder of the State Attorneys General Enforcement Network (STAGE Network) that serves as a resource to the financial services industry, monitoring state AG initiatives, as well as state regulatory developments.

Prior to entering private practice, Mr. Buckley served as Republican Staff Director of the U.S. Senate Banking Committee. During his service on the committee staff, he participated in drafting banking and bank holding company legislation, housing legislation, securities law amendments, Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA), Foreign Corrupt Practices Act (FCPA), Truth in Lending Act (TILA) amendments, and other finance-related legislation. He also assisted in drafting the Equal Credit Opportunity Act (ECOA), the Community Reinvestment Act (CRA), and the Home Mortgage Disclosure Act (HMDA).

Mr. Buckley was selected for inclusion in both Best Lawyers (2013-2018) and Chambers USA: America’s Leading Lawyers for Business (2008-2017). Since 2015, he has been ranked in Chambers as a Senior Statesman in Financial Services Regulation: Consumer Finance (Compliance). Chambers describes him as "a recognized dean of the consumer finance bar." In 2015, Mr. Buckley received the Senator William Proxmire Lifetime Achievement Award from the American College of Consumer Financial Services Lawyers. 

Mr. Buckley received his J.D. from the University of Virginia Law School, and his A.B. from Fairfield University.
